Kenya Enacts Sweeping Gambling Reform with New Regulatory Authority
Kenya’s gambling sector is poised for a significant transformation as the country prepares to transition to a new regulatory regime under the Gambling Control Act of 2025. The law, which received presidential assent in August, establishes a powerful new watchdog and introduces stricter rules for all operators.

A Period of Transition and Preparedness
The existing Betting Control and Licensing Board (BCLB) has suspended all new and renewal license applications. This suspension is in effect until the handover to the new Gambling Regulatory Authority (GRA) is finalized, a process expected to be completed by February 2026. Current license holders can continue operations under their existing terms during this transitional phase.
Leading law firm CM Advocates LLP has issued an alert urging the industry to prepare. The firm advised operators and stakeholders to review their internal policies and operational procedures. This review is to ensure alignment with the new framework under the Gambling Control Act. They emphasized that proactive engagement with the incoming GRA will be critical for a smooth transition.
Broad Powers and Stricter Compliance
The GRA will consolidate oversight across the entire gambling landscape. Its mandate includes online operations and county-level activities that were previously difficult to monitor. The authority will be equipped with broad powers to enforce compliance. These powers include real-time monitoring, inspections, and record checks.
The new Act introduces major reforms focused on accountability and consumer protection. Key provisions include enforced advertising limits and the implementation of self-exclusion programs. Operators will also be required to meet minimum capital thresholds to ensure financial stability. The law introduces stricter penalties for violations, including substantial fines and imprisonment for illegal gambling activities. The GRA will also leverage technology, such as AI and data analytics, to enhance transparency and oversight. CM Advocates LLP noted that early compliance would not only ensure legal conformity but also facilitate a seamless shift into this modernized regulatory era.
